TERMS & CONDITIONS

RESERVATION:

A non-refundable booking fee/deposit of £50 for portraits or 50% for weddings is required to reserve the date and specified coverage. In the event of cancellation, the booking fee/deposit paid is non-refundable. It shall be liquidated damages to CRE8 Photography in the event of a breach of contract by client. The client shall also be responsible for payment for any CRE8 Photography materials charges incurred up to time of cancellation.

PAYMENTS:

Portrait sessions - £50 non-refundable deposit and final payment prior to the photo shoot by cheque or BAC’s or cash on the day.
Commercial photography - First order is payable in full cleared payment prior to delivery. Further orders are payable on 14 days invoice.
Wedding photography - 50% non-refundable deposit on booking your wedding with us and final 50% cleared payment one month prior to wedding.
PLEASE NOTE: late payments will be charged a £35 admin fee.

EXPENSES:

Where the location is greater than 20 miles from NN6 0BB the client is responsible for all extra travel costs.

ENTIRE AGREEMENT:

This agreement contains the entire understanding between CRE8 Photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

CO-OPERATION:

The parties agree to cheerful co-operation and communication for the best possible result within the definition of this assignment. CRE8 Photography is not responsible if key individuals fail to appear or co-operate during photography sessions or for missed images due to details not revealed to CRE8 Photography.

SHOOTING TIME / ADDITIONS:

The photography schedule and selected methodology are designed to accomplish the goals and wishes of the client in a manner enjoyed by all parties. The client and CRE8 Photography agree that cheerful co-operation and punctuality are therefore essential to that purpose. Photography commences at the scheduled start time. Any additional time occurred will be charged at the hourly rate of £75.

DELIVERABLES:

See Package* - After the photographic session/event CRE8 Photography will transfer all images taken to suitable computers, create backup copies for archive and carry out image corrections to cover exposure, colour, contrast, etc. Some images will be converted to black and white, sepia, etc. purely to show what these effects could look like on your images. Any out of focus or other bad images will be deleted. CD of images = your chosen images from your photography session will be supplied to you on a disc for your own use, accompanied with a copyright letter alowing you to print and for your use. We advise that when having your images printed elsewhere that you use a professional printer or photographic lab with design and photographic skills, CRE8 will not be held responsible for any prints or merchandise you have printed from the CD anywhere else.

The images from your photography session will be displayed on our website under the private password viewing area. The photography session includes colour and B&W images and we will add some images with unique creative retouching - this is included in the photography price. Should you require any further images colour poping, montages, posterization or manipulation of any photographs then this will be charged as an extra cost.

PHOTOGRAPHY VIEWING:

Portrait and wedding clients can view online through our website. Log onto the website and go to the viewing area and enter your password in the box provided. Please note password is all one word and lowercase. Photographs, canvas images etc. can be bought on the website and paid for online or via cheque. Please ask for more details. CD of images = your chosen images from your photography session will be supplied to you on a disc for your own use, accompanied with a copyright letter alowing you to print and for your use. We advise that when having your images printed elsewhere that you use a professional printer or photographic lab with design and photographic skills, CRE8 will not be held responsible for any prints or merchandise you have printed from the CD anywhere else.

COPYRIGHTS:

The 1998 Copyright, Designs and Patents Act says CRE8 Photography holds and owns outright copyright to all images captured by CRE8 Photography or it’s representatives. By booking a photographic session, all clients are agreeing to allow CRE8 Photography to use all captured and stored images for the purpose of marketing, promotion, publication, advertising and printing. The images may be used for any commercial purpose relating to the activities of CRE8 Photography. The images may also be used in various formats including, but not limited to, digital files, printed copy, website and film”. If you purchase a CD of images you will receive a letter allowing you to print and use these images for your own personal use. CRE8 do not take any responsibility for printing etc you may have done anywhere else.

EXHIBITION:

Client grants CRE8 Photography permission to display selected images resulting from this assignment as an example of CRE8 Photography work, for use on the CRE8 website, advertising the business, for entrance into photographic competitions and release all claims to profits that may arise from use of images.

MODEL RELEASE:

The Client hereby grants to CRE8 Photography and its legal representatives and assigns the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases CRE8 Photography and its legal representatives and assigns from all claims and liability relating to said photographs. The client also signs this contract for all client’s in the group on the day and permission has been granted also by other members of the group.

LIMIT OF LIABILITY:

In the unlikely event that the photographer is injured or becomes too ill to photograph, CRE8 Photography will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. CRE8 Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond CRE8 Photography control, CRE8 Photography liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

PRIVACY:

CRE8 Photography will store your name and details on a private internal database purely for the purposes of administering our service to you. These details will not be made available to external companies or individuals. Should you wish to have your details removed from our database, please advise us in writing via recorded delivery or E-mail (once we have confirmed receipt of letter from you we will no longer send you information).

CHILDREN:

By signing this document you have agreed that any children photographed by CRE8 Photography are either yours or the parent’s have agreed to you getting them photographed. The children will be accompanied at all times by yourself.

These terms and conditions are true as from the 1st of June 2010 and can be changed at any time without notice. Please see your up to date terms and conditions on the reverse of your signed photography agreement.
